These terms govern your use of the Faireleads marketplace as a buyer firm. For details specific to purchasing and claiming leads, see our Lead Purchase Policy.
These Terms of Service ("Terms") govern access to and use of faireleads.com and our marketplace portal (currently operated in partnership with LeadSwitchboard.io) by tax resolution firms, attorneys, enrolled agents, CPAs, and their authorized staff ("Buyer," "you"). By creating an account or purchasing credits, you agree to these Terms and to our Lead Purchase Policy and Privacy Policy, which are incorporated by reference.
Faireleads ("we," "us," "Vantree LLC") operates a marketplace connecting buyer firms with individuals who have expressed interest in tax resolution help. We are a marketplace and lead distribution service. We are not a law firm, are not your legal or tax advisor, do not represent taxpayers, and do not guarantee that any lead will result in a signed client, a successful case outcome, or any particular revenue.
You represent that you (or the firm you represent) are legally authorized to provide tax resolution, tax representation, or related services in the jurisdictions where you intend to contact leads, including holding any required professional licenses (enrolled agent, CPA, attorney bar admission) and any applicable state debt-adjuster or lead-purchaser registrations (for example, California DFPI registration, where applicable to your activities).
You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity that occurs under your account, including credit purchases and lead claims made by your staff.
You are solely responsible for your own compliance with the Telephone Consumer Protection Act (TCPA), the FTC's Telemarketing Sales Rule, applicable state debt-adjuster and lead-generator regulations, and Circular 230 (where applicable) once you claim and contact a lead. Faireleads provides a TrustedForm consent record with each claimed lead, but this does not substitute for your own independent compliance program.

Use of credits, pricing, refunds, and lead disputes are governed by our Lead Purchase Policy.
The Faireleads name, logo, website, and marketplace platform are our property or that of our licensors. These Terms do not grant you any rights to our intellectual property beyond what's needed to use the marketplace as intended.
The marketplace and all leads are provided "as is" and "as available." We do not warrant that any lead is free of errors, that the marketplace will be uninterrupted, or that any particular volume or quality of leads will be available at any time.
To the maximum extent permitted by law, Faireleads and Vantree LLC will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, arising from your use of the marketplace or any lead purchased through it. Our total liability for any claim will not exceed the amount you paid us in the 3 months preceding the claim.
You agree to indemnify and hold Faireleads harmless from claims arising out of your contact with, or representation of, any lead purchased through the marketplace, including claims alleging TCPA, state debt-adjuster, or professional-conduct violations by you or your firm.
We may suspend or terminate your account for violation of these Terms, including reselling leads, fraudulent claiming activity, or failure to maintain required licensing. Unused credits at termination are handled per our Lead Purchase Policy.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, unless otherwise required by applicable consumer-protection law.
We may update these Terms from time to time. Continued use of the marketplace after changes take effect constitutes acceptance of the updated Terms.
